Background:
|
In March of 2020, Governor Gavin Newsom proclaimed a State of Emergency to exist in California as a result of the threat of COVID-19 and issued Executive Order N-25-20, which allowed for a deviation of teleconference rules required by the Brown Act. Executive Order N-25-20 was extended and amended by Executive Order N-29-20 and subsequently N-08-21 which expired on September 30, 2021.

Assembly Bill (AB) 361 was signed into law on September 16, 2021. It extends the flexibilities provided in the Governor’s prior executive orders to local and State bodies to hold public meetings remotely during a gubernatorial proclaimed State of Emergency under modified Brown Act requirements, similar to the rules and procedures established by the Governor’s Executive Orders. Under Assembly Bill (AB) 361, the Livermore Valley Joint Unified School District (LVJUSD) may continue to hold remote Brown Act meetings. The Board of Education must find that in-person meetings “present imminent risks to the health and safety of attendees.” These findings must be renewed every 30 days. The proposed Resolution is applicable to any Brown Act meeting through November 18, 2021.
