Quick Summary / Abstract: Staff is bringing a recommendation forward for our Board of Trustees to approve Resolution No. 020-21/22, Acceptance of the Distribution Panel Upgrades Project at Livermore High School - Notice of Completion.
Background: On April 15, 2021, bids were received to replace the existing 1600-amp distribution panel at Livermore High School, located near Building J, next to the metal shop. At the May 4, 2021, Board Meeting, our Board of Trustees approved a contract with the lowest responsive and responsible bidder, Nema Construction, with the option of possible "add alternates" that were included in the bid documents.
Status Nema Construction completed the Distribution Panel Upgrades Project at Livermore High School on August 22, 2021.

The Maintenance, Operations, and Facilities Department is submitting Resolution No. 020-21/22, Acceptance of the Distribution Panel Upgrades Project at Livermore High School - Notice of Completion, to our Board of Trustees for approval and is requesting our Board of Trustees’ direction to file a Notice of Completion (NOC) with the Alameda County Recorder’s Office. Filing the NOC notifies subcontractors and suppliers that the project is complete and that they should have been paid by the general contractor. Businesses owed payment on this project have time to file stop notices which restrict our District from paying any final retention amounts to the general contractor until the expiration of the required 35-day time period. Should there be any outstanding stop notices on the project, our District will withhold payment from the general contractor as appropriate.

Also included in this item is ratification of Change Order #1.

On April 3, 2020, our Board of Trustees voted unanimously in favor of Resolution No. 051-19/20, Designating Public Works Projects as an Essential Government Function and Delegating Authority to Designate Further Public Works Projects as an Essential Government Function. This project has been designated as an essential government function public works project.
Fiscal Impact The original contract amount was one hundred twenty-nine thousand dollars ($129,000.00) with the option for possible "add alternates" of up to two hundred twenty-eight thousand four hundred dollars ($228,400.00), with an estimated total of three hundred fifty-seven thousand four hundred dollars ($357,400.00). Staff is requesting the ratification of a change order of two hundred thirty-eight thousand nine hundred twelve dollars ($238,912.00), for the total contract sum of three hundred sixty-seven thousand nine hundred twelve dollars ($367,912.00), exceeding the initial bid by ten thousand five hundred twelve dollars ($10,512.00). This is a Measure J funded project.
Superintendent's Recommendation: The Superintendent's recommendation is that our Board of Trustees approve Resolution No. 020-21/22, Acceptance of the Distribution Panel Upgrades Project at Livermore High School - Notice of Completion.
