Quick Summary / Abstract: Staff will present a resolution for Board approval, which identifies the relative order of termination of certain certificated employees in the event of the layoff of certificated employees.
Background: During layoffs, the Board of Education may establish the order of seniority of employees who have identical seniority dates. Education Code 44955(d)(1) permits a school district to retain junior staff when a district can demonstrate a specific need for personnel to teach a specific course/program. Staff is recommending that the following criteria be used in determining the order of termination based upon the needs of the District and students:

1. Category I - English Learner (EL) Certification;
2. Category II - Credential;
3. Category III - Professional Preparation: Each K-12 Preliminary; or Professional Clear credential held for services, each K-12 added authorization, each Master's degree held, National Board Certification, Doctoral Degree;
4. Category IV - Experience; and
5. Category V - Lottery: If any two or more certificated employees who first rendered paid service on the same date still have the same number of points after application of categories I - IV provided above, the ranking of such employees shall be determined by a lottery.
Status The purpose of this resolution is to identify the relative order of termination of certain certificated employees in the event of the layoff of certificated employees effective at the end of the 2021/2022 school year.
Fiscal Impact There is no impact to the General Fund.
