Staff is requesting Board of Trustees’ approval of Amendment No. 1 to the Lease-Leaseback Contract for Construction of the Livermore High School Athletic Complex and Aquatic Center, Increment 2 (Amendment) to add additional, related work (Fire Alarm Upgrade (Bldgs. A, B, K, L, M, N), Exterior Painting (Bldgs. A, B & M) to the Project) (Project).

Background:
|
Our Board of Trustees (Board) approved a pool of contractors (Pool) qualified to provide lease-leaseback (LLB) construction services at the September 17, 2019, Board meeting. The Board awarded the original LLB contract for the Project to Roebbelen Contracting, Inc. (Roebbelen) at the April 22, 2020, Board meeting. Staff issued a request for proposal (RFP) on November 8, 2021, to the Pool for additional, related work at LHS. On December 15, 2021, the Board selected Roebbelen for the work in the RFP and approved a preconstruction services contract with Roebbelen for that additional work.
Roebbelen has completed the preconstruction services, prepared a cost to construct that additional work, and Staff has reviewed and approved that cost. Legal counsel has concluded that this additional work can be added to LLB Contract as an amendment, in lieu of entering into a completely new contract.

Staff is recommending that our Board approve the Amendment to the LLB Contract with Roebbelen under which Roebbelen will complete this additional work as part of its work to complete the Project.

Fiscal Impact
:
|
The Amendment adds $1,522,165 to the contract for the Project. This is a Measure J funded project.
|
|

The Superintendent's recommendation is that our Board of Trustees approve Amendment No. 1 to the Lease-Leaseback Contract for Construction of the Livermore High School Athletic Complex and Aquatic Center (Increment 2).
