Quick Summary / Abstract: This resolution permits the Livermore Valley Joint Unified School District (“District”) to specify in its Invitations to Bid Tremco Products and related system components pursuant to Public Contract Code section 3400 (“PCC § 3400”) as the only acceptable roofing systems for use on future District projects to match roofing systems on other District projects.
Background: On previous District projects, the District installed Tremco Products and related systems at various District sites. The District would like to specify in its Invitations to Bid and specifications for future projects that Tremco Products and related systems are the only acceptable roofing products and systems for installation at future District projects. PCC §3400(c)(2) permits the District to specify that Tremco Products and related systems in the invitations to bid and specifications for future District projects if necessary “in order to match other products in use on a particular public improvement either completed or in the course of completion.” Specifying the Tremco Products and related systems for future District projects would match the Tremco Products and related systems previously installed at District school sites and would increase maintenance efficiency and warranty processing.

On April 3, 2020, our Board of Trustees voted unanimously in favor of Resolution No. 051-19/20, Designating Public Works Projects as an Essential Government Function and Delegating Authority to Designate Further Public Works Projects as an Essential Government Function. These projects have been designated as essential government function public works projects.
Status Bid documents will be developed in January 2022, followed by the bidding of roof replacement projects at Arroyo Seco Elementary School, Livermore High School, Marylin Avenue Elementary School, and Rancho Elementary School. Work will be completed in the summer of 2022.
Fiscal Impact These projects will be funded by Measure J.
Superintendent's Recommendation: The Superintendent's recommendation is that our Board of Trustees approve Resolution No. 030-21/22, Approval of the Designation of Specific Material(s), Thing(s), Product(s), or Service(s) for Roof Replacement Projects Pursuant to Public Contract Code Section 3400(c)(2).
